I have attempted to gather into one location many documents that are in some
way related to the "Property Owners' Association of Terlingua Ranch, Inc."
also known as POATRI. As the
folder name suggests, the content of this site is intended to present only documents
which have in fact been recorded somewhere. It is not intended to imply that the
content of these documents is factual or true or that the documents are valid.
Public records are hosted at this site. Publications by POATRI are
presented via links to the POATRI website.

Maintenance Agreement |
Terlingua Ranch Maintenance Association This document is often referred to as the TRMA, the MA, or the Maintenance Agreement and often the word Association is incorrectly replaced with the word Agreement as in "Terlingua Ranch Maintenance Agreement". This is the original document, prior to the many amendments. The two original Exhibits A and B are included. Name Change - Great Western becomes Terramar Filing with the office of the Secretary of State in which Great Western Corporation changes its name to Terramar. TRMA Amendment - Addition of Property in 1974 This PDF file contains not only the Amendment in which property was added to Terlingua Ranch, but also contains copies of the 3 deeds which are referenced in the Amendment. The deeds are necessary to determine what properties are added. Resignation and Designation of Administrator The document filed in the Brewster County property records in which Terramar resigns as administrator of the TRMA and designates POATRI as its successor. July 1979 Amendment to the TRMA - Changes Section X Revokes need for owners of 51% of property to change TRMA, allows changes to be made by vote of members of POATRI eligible to vote at a meeting. January 1980 Amendment to the TRMA - Changes Section I Changes fees to $2.50 per month per owner plus 4 cents per acre per month. May 1986 Amendment to the TRMA - Changes Section I Changes fees to $4.25 per month per owner plus 4 cents per acre per month. June 1990 Amendment to the TRMA - Changes Section X Continues ability to amend TRMA by eligible voters at meeting, adds ability to amend TRMA by mail. March 1999 Amendment to the TRMA - Changes Sections I and X Removes language from Section I which exempted developer from payment of maintenance fees and removes language from Section I which gives developer rights to exempt properties from maintenance fees. Replaces Section X in its entirety, eliminating ability to amend TRMA by vote at meeting requiring amendments to be made by an election by mail. August 2000 Amendment to the TRMA - Changes Section IX Requires absolute majority of POATRI members in good standing to terminate the TRMA. July 2005 Amendment to the TRMA - Changes Section X Changes majority of members in good standing to majority of members in good standing who vote to make amendments to TRMA. July 2005 Amendment to the TRMA - Changes Section I Changes fees to $142 beginning in Nov 2005 and allows annual increases based on cost of living adjustments made annually based on consumer price index. Removes per acre fee. Places maintenance fee on only one tract per owner. No monthly fees, all fees to be computed annually in December and due by March 31st. |

Easements |
1976 Easement from Terramar to POATRI Limited easements and right of use of easements granted by Terramar to POATRI for the limited purposes of maintaining roads and maintaining a well and associated equipment. 2004 Transfer from Terramar to Brewster County Oil Company Deed transferring all properties and all rights Terramar still owned as of the date of the deed to Brewster County Oil Company. Document was signed by Catherine Colleen Hanratty both as an individual and as the president of Terramar and by Thomas Guderjan as an individual. Seals are present showing original recording date, date of certification of copy, and date of filing as an Exhibit in a case in District Court. 2006 Easement from Terramar to POATRI Recorded easement from Terramar to POATRI. Believed to be invalid because Terramar had already transferred all of their right to Brewster County Oil Company two years previously. Letter from an Attorney representing Brewster County Oil Company posted 12-06-11 Letter from Charles Blackley warning POATRI that 2006 Easement is a fraud. This letter was prompted by POATRI's policy of making all TR property owners benefactors of the easement they were granted in 2006. The policy was included in a proposed settlement of a lawsuit filed in Brazoria County as a "member derivative" suit, basically making all members of POATRI parties to the lawsuit. Order Declaring 2006 Easement Invalid posted 12-06-11 As partial summary judgment in the case of POATRI vs Suber, the 2006 easement from Terramar to POATRI was declared invalid. Suber "Final" Judgment June 19, 2012 This "final" judgment was rendered in June 2012. POATRI's attorney objected that it was too broad and covered all TR properties instead of just those belonging to Craig Suber and specified in the suit. Amended Final Judgment and Findings of Fact and Conclusions of Law August 27, 2012 The amended final judgment narrows the judgment to the Suber properties, but the accompanying findings of fact and conclusions of law make it clear that the situation applies to TR properties in general. NPS Easement to Christmas Mtns An easement was granted by the General Land Office to the National Park Service to allow visitors to the National Park to enter the Christmas Mountains on foot from the common boundary between the park and the Christmas Mountains property. I have not linked to a separate document here, because this easement was recorded both in the records of Brewster County at Volume 228 Page 734 but also as Exhibit D to the lease to POATRI of the Christmas Mountains. The document is included in the file Final Christmas Mountains Lease and it would be redundant to make a separate link. |

Braun Vs POATRI posted 03-08-09 Original Petition filed as CAUSE NUMBER 2008-07-B8759-CV in the District Court of Brewster County, Texas, 394th Judicial District. Alpine Avalanche Article 06-30-88 posted 03-08-09 June 30, 1988 Article from the newspaper, the Alpine Avalanche providing a brief description of the initial outcome of a lawsuit filed by Charles Bradford against POATRI for recording the 1986 amendment to the TRMA and collecting fees based on the amendment. Temporary Partial Waiver - 1 posted 03-08-09 Document filed in December 2008 by POATRI claiming to waive fees on the former hunt park properties, but only until ownership of the tracts changes. Temporary Partial Waiver - 2 posted 12-06-11 Document filed in October 2007 by POATRI claiming to waive fees on a variety of properties, but only until ownership of the tracts changes. Temporary Partial Waiver - 3 posted 12-06-11 Document filed later in October 2007 by POATRI claiming to waive fees on a few properties, but only until ownership of the tracts changes. Gift Deed for Christmas Mountains posted 06-11-10 Deed of Christmas Mountains property to the state of Texas showing restrictions on property. Draft Christmas Mountains Lease The DRAFT of the lease of the Christmas Mountains to POATRI was distributed at a board meeting just before the final lease was signed. The draft lease is no longer hosted here. The final lease is recorded in the state capital, but all that is filed in Brewster County is a memorandum stating that the lease exists. Final Christmas Mountains Lease posted 08-03-10 The final version of the lease of the Christmas Mountains to POATRI (31 pages including all exhibits control document, map, Gift Deed, and the NPS Special Document and a copy of the lease memorandum).
